• General Terms and Conditions
Placing an order
After selecting products and providing identification details (all mandatory fields on electronic form must be filled out), an order number is allocated to the customer. It is understood that when the customer clicks on the "Place order" button, the customer has placed an order online and has fully acknowledged and agreed to the present conditions.
The sole transmission of this order number does not constitute an acceptance of the order; the HYPSOÉ company becomes legally bound only after the bank transaction has been approved by HYPSOÉ securitization partners, regardless of the type of payment made via the web site.
The automatic registration systems are considered legal proofs of the nature, content, and date of order.
HYPSOÉ sends an order confirmation to the customer at the email address provided by the customer. Sale shall be confirmed only after order validation by HYPSOÉ. HYPSOÉ reserves the right to cancel any sale to a customer in case of outstanding dispute regarding payment of a prior order.
Information provided by the buyer while placing the order is binding: in case of a mistake when typing detailed information (address, etc .), the HYPSOÉ company shall not be deemed responsible for the impossibility to deliver the product.
After order validation, a detailed invoice can be viewed and printed by the customer on the website, under "my account".
Availability
Products are available for as long as they are displayed on the website, subject to stock availability.
In case a product is unavailable after an order has been confirmed, HYPSOÉ shall inform the customer by email. The order shall then be automatically canceled and the customer shall be refunded by check if the bank account has already been debited. In case of partial delivery, HYPSOÉ shall contact the customer to obtain agreement and only the items delivered will be charged.
Payment
Online payment is possible with the following bank or credit cards : Carte Bleue, Visa, Mastercard, Eurocard.
To provide security of online payments, HYPSOÉ uses the «Mercanet» system, the online payment solution offered by Bank BNP Paribas. With that system, payment by card is processed directly onto the BNP Paribas secure server on behalf of HYPSOÉ. The customer card number is not communicated to HYPSOÉ.
Delivery
Orders are processed as soon as they are received and payment is confirmed.
Unless indicated otherwise, products are shipped to the address entered by the customer when ordering on the HYPSOÉ website.
A detailed invoice is included in the shipment.
Products are sent via the French postal system as «colissimo suivi » (with tracking number). If recipient is absent upon delivery, a note is left in the mail-box in order for the customer to go pick up the package at the post-office.
For your information, here are the average delivery times provided by the French Post-Office:
- D+4 days for delivery in France,
- D+5 to D+7 for the rest of Europe.
No return will be allowed that has not first been authorized by HYPSOÉ. Signing the delivery note for the package(s) means express acceptation of the delivery.
Shipping charges
Shipping charges include handling, packing and shipping charges.
Shipping charges are calculated based on the number of products ordered, and vary based on the type of order (amount, nature, volume) and the destination.
Depending on type and weight of the products, they will either be sent via la Poste (up to 30 kg), Chronopost (up to 30kg) or by a carrier (over 30 kg).
Cancellation period
In compliance with articles L. 121-16 and the like of the Code de la Consommation, customers are entitled to a 14 days cancellation period starting on the day the package was received, during which they can request a refund for the product amount, incuding shipping charges.
In that case, customer must inform HYPSOÉ to the sales team at +33 (0) 1 60 61 08 41.
All products must be returned (return shipment costs to be paid by the consumer) in their original package, along with a copy of the invoice, to:

Important : If customer fails to comply to the return procedure, HYPSOÉ shall be entitled to refusing refund or exchange of the product.
Conformity of order and products
Upon product delivery, the customer must carefully verify the package(s) and check the content while delivery person is present, before signing the delivery note.
If delivered products have been damaged during transportation (broken, bent, crushed, ...) or do not meet the specifications of customer purchase order (product error), the customer must refuse the package(s) by legibly stating the motive on the delivery note. The package(s) will then be returned to HYPSOÉ and replaced at no additional charge.
If some products are missing, the customer must legibly write on the delivery note all reservations in a detailed and specific manner; the customer must also indicate the number of boxes and the description of the missing products before signing the delivery note. The customer then confirms to HYPSOÉ which products are missing via the form on the "contact us..." page of the web site, along with the order number.
In the absence of detailed comments on the delivery note, the goods shall be deemed delivered in due form.
Privacy
In compliance with the "Informatique et libertés" law, customers have the right to access the information pertaining to them. As per the law n°78-17, January 6th, 1978, any person has a right to modify or delete their personal information by sending an email through the website or a letter to HYPSOÉ 3 Route de Messy 77410 CHARNY – France.
Conflicts
The applicable law regarding to the terms and conditions of the present contract is the French law.
Responsibility
The HYPSOÉ company shall not be liable for failure to comply with the local law of the country where the products are delivered. It is the customer’s responsibility to ask local authorities about the rights to import or use the products or services that the customer wants to order.
The photos and product descriptions provided on the www.gillesdewavrin.fr website have no contractual value.
